Yes. NRIs (Non-Resident Indians) can freely purchase residential plots, villa plots, apartments, and commercial property in India without RBI approval. This is governed by FEMA (Foreign Exchange Management Act). The only exceptions are agricultural land, plantation property, and farmland β€” which require RBI permission.
Payments can be made through your NRE (Non-Resident External), NRO (Non-Resident Ordinary), or FCNR (Foreign Currency Non-Repatriable) bank account in India. Direct international wire transfers to the seller's Indian bank account are also permissible. All payments must be through regular banking channels β€” not cash.
No. The entire purchase can be executed remotely. You can sign documents digitally or via a registered Power of Attorney (POA). The POA holder (a trusted friend, family member, or attorney) can represent you at the Sub-Registrar's office for property registration. The POA must be attested by the Indian Embassy/Consulate in your country.
Yes. If the purchase was funded through an NRE account, sale proceeds can be fully repatriated.
